Every Step You Take: The Patent Venue Battle Over Method Claims

This session will examine the live debate over whether 28 U.S.C. § 1400(b) requires plaintiffs to allege that defendants performed all steps of a claimed method within a judicial district for venue to be proper, or whether performing only a subset of steps suffices. We will discuss the Comcast en banc petition and its implications for patent litigation strategy.

Transatlantic Patent Wars: Navigating the Tide of U.S. Litigation in European Courts

Key differences between U.S. and European courts have made the latter an increasingly attractive option for patent plaintiffs, especially following a decision of the Court of Justice for the European Union that expands the ability of European courts to hear disputes involving other countries’ patents. This session will explore the latest developments in extraterritorial patent enforcement and strategies for plaintiffs and defendants dealing with potential patent disputes on both sides of the Atlantic.
