Examples of Zach’s experience include:

• Representing a personal care products manufacturer and retailers in an action in the Eastern District of California involving allegations of antitrust violations, patent infringement and trade dress infringement by a competitor manufacturer. After hotly litigated activity in the pleadings and discovery stages, including several successful pleadings motions narrowing the issues for the case and over a dozen depositions, and working together with the client’s key retailer, successfully moved for summary judgment of non-infringement and dismissal of antitrust claims.
• Representing an assignee of claims for right of publicity violations in an action in Los Angeles County through all stages of the case, from pleadings through trial and appeal. Developed a creative resolution to address failure of the would-be indemnitor to defend and indemnify defendant, including assignment of indemnity claims from defendant to client. Defeated the indemnitor’s post-trial challenges, including motion to vacate the judgment and opposition to motion for attorney’s fees.
• Representing a consumer goods manufacturer in several actions in the Central District of California concerning infringement of the client’s trademarks and trade dress, including a successful motion for preliminary injunction, motions for partial summary judgment, and pretrial preparations bringing case to the eve of trial resulting in settlement.
• Obtaining registration of a color mark for a major personal care brand after appealing the USPTO’s rejection of its application. Also secured dismissal of oppositions filed by two competitors.
• Representing an employer in an action in Alameda County to recover damages from embezzlement by a former employee and the former employee’s spouse, including claims for treble damages pursuant to Cal. Pen. Code § 496(c). Successfully pursued claims through removal to the Bankruptcy Court for the Northern District of California after the defendant filed for bankruptcy. First-chaired trial through a favorable judgment in an adversary proceeding in the bankruptcy court, along with dischargeability of that liability. Obtained further enhanced damages, fees and costs through appeal.
• Representing a purchaser of life insurance policies in life settlement transactions in the Central District of California involving claims for fraud in connection with the purchase and sale of those policies. Successfully litigated the case through trial, resulting in a favorable settlement during jury deliberations.
• Representing a charitable organization in a false advertising class action. Obtained a ruling denying class certification, resulting in dismissal of the entire action.
• Representing numerous clients in Uniform Domain Name Dispute Resolution Policy (UDRP) proceedings before the National Arbitration Forum and World Intellectual Property Organization, obtaining transfer of domain names that infringed a client’s trademarks.
