Focus Areas

Examples of Jennifer’s experience include:

  • DigiMedia Tech, LLC v. Canva Pty Ltd, Case No. 25-cv-00808-RWS-RSP (E.D.Tex.) and Canva US, Inc. v. DigiMedia Tech, LLC and IP Investments Group, LLC, Case No. 25:-cv-051610-JPB (N.D.Ga.) Represented Canva in these related cases after DigiMedia sued Canva Pty Ltd for patent infringement, filing a complaint in Georgia against DigiMedia and its licensing arm, IP Investments Group, seeking declaratory judgment of non-infringement and asserting claims under Georgia Fair Business Practices Act, O.C.G.A. § 10-1-771 for making bad faith assertions of patent infringement, after which both cases settled quickly.
  • Jennifer represents a global medical technology company in asserting its foundational patents for renal neuromodulation. The patents claim systems and methods for targeting the renal system nerves to treat drug-resistant hypertension with a minimally invasive procedure. This is one of several cases between the parties currently ongoing worldwide (Germany, Italy, France, UK), before the Patent Trial and Appeals Board, and before the U.S. Court of Appeals for the Federal Circuit.
  • Vincent Systems GmbH v. Fillauer Companies, Inc., et al., Case No. 23-cv-00002-CEA-MJD (E.D.Tenn.) Jennifer represents Vincent Systems against Fillauer Companies in this case involving mechanical technology used in hand prostheses. This is the second case in which Vincent Systems will have successfully enforced its U.S. patents.
  • Accessify LLC v. Canva Inc. and Canva Pty Ltd., Case No. 23-cv-01289 (W.D.Tex.) and Canva US, Inc. v. Accessify LLC and Ascend IP, LLC, Case No. 2:23-cv-1945 (W.D.Wash.) Representing Canva in responding to complaint alleging infringement of eight patents asserted by Accessify in the Western District of Texas, and filing an affirmative action against Accessify LLC and its patent licensing arm, Ascend IP, LLC, in the Western District of Washington asserting, inter alia, violation of Washington State Patent Troll Prevention Act and Consumer Protection Act (RCW 19.86 et seq. and 19.350 et seq.). Both cases were then settled.
  • Represented a global medical technology company in enforcing trademarks for its digital solutions for orthodontic technology, including claims under the Lanham Act for trademark infringement and false advertising.
  • AbCellera Biologics Inc., et al. v. Berkeley Lights, Inc., Case Nos. 20-cv-8624, 20-cv-8626, and 20-cv-8627 (N.D.Cal.) In defending leading digital cell biology company Berkeley Lights, Jennifer litigated three consolidated cases alleging infringement of 15 patents related to cell processing technology, including antibody discovery.
  • Vincent Systems GmbH v. Ossur HF. and Ossur Americas, Inc. Case No. 19-cv-02157 (C.D. Cal.) Serving as lead counsel, Jennifer secured a favorable confidential settlement for German medical technology manufacturer Vincent Systems against a significantly larger player in the industry. The case centered around mechanical technology used in hand prostheses. Settlement followed shortly after a very successful claim construction decision, after which she negotiated a highly favorable settlement for her client against a significantly larger player in the industry.
  • Represented a global medical technology company that makes digital solutions for orthodontic technology in a trademark case, obtaining ruling that its brand is a famous mark.
  • Magnolia Medical Technologies, Inc. v. Kurin, Inc., Case No. 19-cv-00097 (D.Del.) Counsel to San Diego-based Kurin Inc., defending the medical technology manufacturer against claims of patent infringement related to blood draw/medical device technology brought by Magnolia Medical Technologies.
  • Global Supplies NY, Inc. v. Electrolux Home Products, Inc. and Simple Wishes LLC, No. 19-cv-04823 (E.D.N.Y) Lead counsel defending nursing wear company Simple Wishes LLC against claims of patent infringement valued at more than $8 million. Jennifer and her team successfully obtained dismissal of the case with prejudice on a matter of arcane New York law.
  • SHST and VGH v. Rearden, Inc. et al. Case No. 15-cv-00797 (N.D. Cal.) Jennifer acted as lead counsel to technology incubator Rearden, Inc. in a multi-year matter including a successful 2016 bench trial that established Rearden owned MOVA performance facial motion capture technology used in movies, including, for example, Disney’s Beauty and the Beast. During that case, Jennifer obtained a nearly unheard-of mid-case preliminary injunction after the opposing party “disappeared” and was replaced by a new party. Following the court’s decision that Rearden had always owned the MOVA technology, Rearden asserted copyright claims in the billions of dollars against major movie studios for use of the MOVA software without Rearden’s authorization.
