Regulatory Compliance

  • Representing clients across manufacturing, chemical, consumer products, home improvement retail, and transportation sectors, including companies in the rubber, aerospace, automotive, coatings, steel, tools, building materials, and scrap industries.
  • Providing strategic guidance on navigating complex environmental statutes and evolving regulatory requirements.
  • Counseling on CAA Title V and PSD applicability, permitting, and ongoing compliance for major and minor sources.
  • Advising on CWA National Pollutant Discharge Elimination System (NPDES) permitting, stormwater management, and reporting obligations.
  • Supporting compliance with RCRA hazardous and solid waste, storage, transportation, and disposal.
  • Advising on facility closure plans, post-closure obligations, and corrective action requirements for regulated units and facilities.
  • Assisting clients with renewable energy projects.
  • Counseling on underground and aboveground storage tank registration, operation, and closure.
  • Assisting with Spill Prevention, Control, and Countermeasure (SPCC) planning, reporting, and federal/state spill response obligations.
  • Managing complex remediation matters, including vapor intrusion analysis and long-term site liabilities.
  • Guiding compliance with state greenhouse gas reporting, climate disclosure frameworks, and applicable climate statutes.
  • Advising on state and federal wetlands permitting.
  • Counseling on Environmental Social Governance (ESG), green marketing claims, and product labeling compliance.
  • Assessing legal and political risks affecting compliance, investments, and corporate strategy.
  • Interfacing with federal, state, and local policymakers on regulatory matters.

Enforcement & Litigation

  • Defending clients in federal and state enforcement actions, including violations related to air emissions, wastewater, hazardous waste, and permitting issues.
  • Managing all aspects of CERCLA matters, from liability analysis through allocation, remediation, and litigation, including negotiating consent decrees and PRP agreements.
  • Responding to Notices of Violation and federal and state requests for information under CWA, CAA, and CERCLA.
  • Negotiating consent decrees, joint defense agreements and coordinating multi-party enforcement strategies.

Environmental Transactions

  • Advising clients on environmental risks in corporate and real estate transactions, including Phase I/II environmental due diligence, liability allocation, and permit transfer or termination.
