On November 26, 2025, the Office of the U.S. Trade Representative (USTR) issued a <a href="https://www.govinfo.gov/content/pkg/FR-2025-12-01/pdf/2025-21671.pdf" target="_blank" rel="noreferrer noopener">Federal Register notice</a> announcing the extension of exclusions in the Section 301 Investigation of China&rsquo;s Acts, Policies, and Practices Related to Technology Transfer, Intellectual Property, and Innovation. The 178 exclusions were previously scheduled to expire on November 29, 2025, but have now been extended until November 10, 2026.&nbsp;Two annexes to the USTR notice confirm that all exclusions under (i) heading HTSUS 9903.88.69 and U.S. notes 20(vvv)(i), 20(vvv)(ii), 20(vvv)(iii), and 20(vvv)(iv) to subchapter III of chapter 99 of the HTSUS and (ii) heading 9903.88.70 and U.S. note 20(www) to subchapter III of chapter 99 of the HTSUS have been extended, effective November 30, 2025.
On August 28, 2025, the USTR continued the extension of these product exclusions and sought public comments on any further extensions (see Thompson Hine Updates of <a href="https://www.thompsonhinesmartrade.com/2025/09/ustr-continues-extension-of-limited-product-exclusions-for-china-section-301-tariffs/">September 2, 2025</a> and <a href="https://www.thompsonhinesmartrade.com/2025/09/ustr-seeks-comment-on-possible-extension-of-remaining-china-section-301-product-exclusions/">September 16, 2025</a>).&nbsp;Based on public comments received and negotiations with China, President Donald Trump directed the year-long extension until November 2026.
