On February 6, 2026, President Donald Trump signed an <a href="https://www.whitehouse.gov/presidential-actions/2026/02/addressing-threats-to-the-united-states-by-the-government-of-iran/">Executive Order</a> continuing the national emergency with respect to Iran and establishing a process to impose tariffs on countries that acquire any goods or services from Iran to protect the national security, foreign policy, and economy of the United States.&nbsp; The Executive Order &ldquo;impose[s] an additional&nbsp;ad valorem&nbsp;duty on imports of articles that are products of foreign countries that directly or indirectly purchase, import, or otherwise acquire any goods or services from Iran.&rdquo;&nbsp; Such tariffs, if imposed, would be implemented pursuant to the International Emergency Economic Powers Act (IEEPA).
Such tariffs &ldquo;may be imposed on goods imported into the United States that are products of any country that directly or indirectly purchases, imports, or otherwise acquires any goods or services from Iran&rdquo; only after: (i) &nbsp;the Secretary of Commerce (in consultation with the Secretary of State) determines that a foreign country directly or indirectly purchases, imports, or otherwise acquires any goods or services from Iran; and (ii) the Secretary of Commerce issues an affirmative finding on such importations and determines whether and to what extent an additional ad valorem rate of duty should be applied.&nbsp; Any final decision on a recommended determination and finding for the implementation of duties would be made by President Trump.&nbsp; As necessary, the Departments of Commerce and State may issue rules, regulations, and guidance necessary or appropriate to implement this Executive Order.
