In August 2022, the Chemical Safety and Hazard Investigation Board (“CSB”) released guidance further defining reportable “accidental releases” causing property damage or injuries under CSB’s 2020 reporting rule (40 CFR 1604). The 2020 reporting rule represented a new regulatory reporting obligation for regulated entities that required additional reporting to CSB in the event of certain emergency events such as facility explosions and fires. Importantly, these reporting obligations are in addition to a regulated entity’s potential reporting obligations to the United States Environmental Protection Agency, state environmental protection agencies and OSHA.

CSB’s authority to issue the reporting rule arises under Section 112 of the Clean Air Act (42 U.S.C. 7412) and the rule requires regulated entities to report to CSB any “accidental release” resulting in a fatality, serious injury, or substantial property damage. An “accidental release” is defined as an “unanticipated emission of a regulated substance or other extremely hazardous substance into the ambient air from a stationary source.” CSB’s recent guidance, however, interprets these terms extremely broadly to encompass emissions that are not traditionally regulated by the Clean Air Act such as steam and dust emissions that result from most explosions or fires.

While the 2020 reporting rule became effective in 2021, we recommend renewed focus on reporting obligations in light of CSB’s recent guidance.
