An overview of recent court decisions in the class action context as they relate to the chemical industry as well as other tools and strategies to manage and potentially avoid litigation costs in mass tort and class action litigation.

9:15-9:45 a.m. – The New Asbestos Is … Asbestos
Current trends in asbestos litigation, focusing on efforts by the plaintiffs’ bar to identify a new class of asbestos clients through “take-home exposure” cases, including an analysis of scientific and legal bases for contesting such claims.

9:45-10:30 a.m. – Employee Injury Prevention in the Chemical Industry
A review of employee injury incident rates and trends in the chemical industry and how they relate to general industry. In addition, we will review the most frequently cited OSHA standards in the chemical industry and discuss their basic requirements, and examine typical prevention controls for common types of employee injuries in the chemical industry.

An overview of 2014 court decisions and trends impacting liability under the Comprehensive Environmental Response, Compensation, and Liability Act. Topics will include recent decisions interpreting the impact of governmental settlements on statute of limitation defenses, developments in the apportionment of CERCLA liability and more.
