Winning Isn't Enough: Ensuring Recovery in Cross-Border Disputes

When facing disputes, businesses and their lawyers often overlook the crucial difference between victory and success: whether a judgment or arbitral award will result in an actual recovery. The importance of the issue is even greater in cross-border disputes, where adversaries and target assets often are located in overseas jurisdictions, which present very different legal and political concerns. Properly addressing this mission-critical point requires an approach that is not taught in most law schools, and that entails fundamental changes to the usual modes of planning, budgeting and management of a case. Failing to appropriately prepare from the outset, moreover, can doom a costly effort to ultimate failure, even if the merits case is won in court.

Please join Timothy McCarthy, a partner with Thompson Hine in New York, and Andrew Thorp, a partner with Harneys in the British Virgin Islands, for a program examining the basics of cross-border enforcement and recovery, from both a U.S. and Commonwealth perspective. They also will offer guidance and answer questions about the methods available to businesses to ensure that when they begin a case, they can recover what has been lost.

• Preliminary enforcement measures, such as attachments and injunctions
